ELSINORE grants the licensee the right to use the enclosed software on a single computer workstation, or in a network server environment. However, the number of users of the software at any one time depends solely on the number of licensing agreements held by the licensee, be that an individual or an organization.
2. COPYING:
Copies of the enclosed software may be made and distributed within an organization if and only if additional licenses are purchased and adhered to in accordance with the terms and conditions set forth by ELSINORE. ELSINORE grants the licensee the right to make one copy of the software or install the software onto a hard drive for backup or archival purposes only.
3. COPYRIGHT:
The software and all other materials contained within the software package are the sole property of ELSINORE and are protected by the United States copyright laws and international treaty provisions. The software may be copied so long as the provisions above are followed, but the accompanying materials (manual, quick reference card, etc.) may not be reproduced in any form.
4. OTHER RESTRICTIONS:
ELSINORE prohibits the licensee from renting, leasing, displaying, copying or distributing the software or any of its accompanying components except as permitted in this licensing agreement. The licensee may use the enclosed software to develop and test other software, but in no way may the enclosed software be disassembled or decompiled.
Elsinore Technologies, Inc, warrants that (a) the software will perform substantially in accordance with the accompanying written materials for a period of ninety (90) days from the date of receipt, and (b) any hardware accompanying the software will be free from defects in materials and workmanship under normal use and service for a period of one (1) year from the date of receipt. Any implied warranties on the software and hardware are limited to ninety (90) days and one (1) year, respectively. Some states/jurisdictions do not allow limitations on duration of an implied warranty, so the above limitation may not apply to you.
Elsinore Technologies, Inc's. and its suppliers' entire liability and your exclusive remedy shall be, at Elsinore Technologies, Inc's. option, either (a) return of the purchase price, or (b) repair or replacement of the software or hardware that does not meet Elsinore Technologies, Inc's. Limited Warranty and which is returned to Elsinore Technologies, Inc. with a copy of your receipt. This Limited Warranty is void if failure of the software or hardware has resulted from accident, abuse, or misapplication. Any replacement software or hardware will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer.
To the maximum extent permitted by applicable law, Elsinore Technologies, Inc. and its suppliers disclaim all other warranties, either express or implied, including , but not limited to, implied warranties of merchantability and fitness for a particular purpose, with regard to the software, the accompanying written materials, and any accompanying hardware. This limited warranty gives you specific legal rights. You may have others, which vary from state/jurisdiction to state/jurisdiction.
To the maximum extent permitted by applicable law, in no event shall Elsinore Technologies, Inc. or its suppliers be liable for damage whatsoever (including, without limitation, damages for loss of business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this Elsinore Technologies, Inc. product, even if Elsinore Technologies, Inc. has been advised of the possibility of such damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
The software and documentation are provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 pr subparagraphs (c)(1) and (2) of the Commercial Computer Software - Restricted Rights at 48 CFR 52.227-19, as applicable.
